Preparation of Proposals for Public and Private Tenders

A tender is understood as the administrative procedure for the acquisition of supplies, performance of services or execution of works (construction). 


Also called public tenders, its objective is to offer and ensure the acquisition of goods and services by the State and/or private parties. Suppliers can be self-employed, SMEs or large companies as long as any of them meets the required conditions. 


The process consists of the publication of a tender with its corresponding specifications by the entity interested in contracting, these include all the requirements so that the different bidders can send an appropriate proposal. With all the proposals received, the contracting party will select and award the one it considers optimal. 


What are the types of tenders? In general terms, there are two types of tenders: 


Public tenders: Contract where a state entity makes a public call, so that in equal opportunities, the interested parties present their offers and the entity sign the contract to the most appropriate proposal. Therefore, this type of bidding entails the obligation on the part of the public entity to use publicity and ensure the transparency of the process.

Private bids: They entail a process like the public bids, but the invitations are made expressly to a certain small number of companies and not by public announcement. Some of the justifications for a private bid are: 

  • Cases of extreme urgency and/or an emergency.
  • Need for confidentiality of the service. 
  • To award public tenders that have been deserted (without bidders).


In Panama, bidders interested in participating in a Tender for a Framework Agreement must be aware of the actions of the General Directorate of Public Procurement within the page www.panamacompra.gob.pa, located in the link Current Public Acts of Version 2.2, focused on the publication of the list of charges for the tender of the Framework Agreement. 


The interested proponent must download the list of charges, attend the calls and comply with the minimum established requirements and standards.
